Terms of service.

Agreement

By creating an account on StartMyOwn.Restaurant ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform.

Eligibility

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction. You must provide accurate information when creating your account.

Your account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately.

Subscriptions and billing

• Plans — We offer monthly subscription plans (Cook, Kitchen, Restaurant) at the prices listed on our pricing page. Prices may change with 30 days' notice.
• Per-order fee — In addition to your subscription, we charge a small percentage of each order placed through the Platform (roughly 5% on Cook, 3% on Kitchen, and 1% on Restaurant). Standard card-processing fees may also apply.
• Payment — Subscriptions are billed monthly. Payment is processed through Stripe. You authorize us to charge your payment method on file.
• Refunds — Subscription fees are non-refundable. If you cancel mid-cycle, your access continues until the end of the billing period.

Cancellation

You may cancel your subscription at any time from your dashboard or by contacting us. Upon cancellation, your landing page and phone number will remain active until the end of your current billing period. After that, your page will be taken offline and your phone number will be released.

Acceptable use

You agree not to:

• Use the Platform for any unlawful purpose or to promote illegal services.
• Impersonate another person or business.
• Send spam, unsolicited messages, or harassing communications through the Platform.
• Attempt to gain unauthorized access to other accounts or our systems.
• Use the Platform to collect personal information about customers for purposes unrelated to the services you provide.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

Intellectual property

We own the Platform, its design, code, and branding. You own the content you create (business descriptions, photos, etc.). By using the Platform, you grant us a license to display your content on your landing page and in marketing materials.

Limitation of liability

The Platform is provided "as is." We do not guarantee that it will be error-free or uninterrupted. We are not liable for any lost revenue, lost customers, or indirect damages arising from your use of the Platform. Our total liability is limited to the fees you've paid us in the past 12 months.

Disputes

These terms are governed by the laws of the State of Texas. Any disputes will be resolved through binding arbitration in Austin, TX, except where prohibited by law.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll notify you by email. Continued use of the Platform after changes take effect constitutes acceptance of the new terms.
